Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of SpotFacts ("Service", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle personal data and should be read together with these Terms.

SpotFacts provides tools to analyse content you submit or interact with through the Service. Features may include storing a history of your analyses so you can review past results when you sign in again.

4. Accounts and authentication

Access to certain features requires an account. Authentication and sign-in are provided by Clerk Inc., a third-party identity provider. Your use of Clerk is also subject to Clerk's terms and privacy policy.

You must provide accurate sign-in credentials and keep your account secure. You are responsible for activity under your account unless you notify us of unauthorised use.

5. Account data we use

For the purpose of operating the Service and linking your activity to your profile, we process and store at minimum:

• Username (or equivalent user identifier from your account)
• Email address

The sign-up or profile flow may offer optional fields (for example first name and last name). SpotFacts does not rely on or persist those optional fields for the core operation described here; we associate your analysis history with your account using the identifiers above.

6. Analysis history across devices

We store analysis history tied to your authenticated account so you can access the same history when you use the Service from different devices or browsers, as long as you sign in with the same account.

You should not expect the Service to retain data indefinitely; retention may change. You may request deletion of your data as described in our Privacy Policy.

7. Acceptable use

You agree not to:

• Use the Service in violation of applicable law or third-party rights.
• Attempt to gain unauthorised access to systems, data, or other users' accounts.
• Overload, disrupt, or compromise the security or availability of the Service.
• Use automated means to scrape or abuse the Service without our prior written consent.

8. Your content

You retain rights to content you submit. You grant us the licence reasonably necessary to operate the Service (for example to process, store, and display your analyses and history for you). Do not submit content you are not allowed to share or that infringes others' rights.

9. Disclaimers

The Service is provided "as is" and "as available". We do not warrant uninterrupted or error-free operation. Outputs of analysis tools are informational and may be incomplete or incorrect; they are not a substitute for professional advice where that applies.

10. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our aggregate liability for claims relating to the Service is limited to the greater of (a) the amounts you paid us for the Service in the twelve months before the claim or (b) fifty euros (€50), except where mandatory law (for example under German law) provides otherwise.

11. Changes and termination

We may modify these Terms by posting an updated version and updating the "Last Updated" date. Continued use after changes constitutes acceptance of the revised Terms, where permitted by law.

We may suspend or terminate access to the Service if you materially breach these Terms or if we discontinue the Service. You may stop using the Service at any time.

12. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law rules. If you are a consumer with habitual residence in the EU, you additionally benefit from mandatory provisions of the law of your country of residence.

Mandatory consumer protections and venue rules of your place of residence remain unaffected where applicable.
